مطهري در اين خصوص بيان ميدارند كه: «در دنياي غرب از قرن هفدهم به بعد پابهپاي نهضتهاي علمي و فلسفي، نهضتي در زمينه مسايل اجتماعي و به نام حقوق بشر صورت گرفت. ژان ژاك روسو، ولتر و منتسكيو از نويسندگان و از هنگامي كه اعلاميه حقوق بشر و ميثاقين تدوين و تصويب شدهاند براي جهاني كردن و تضمين رعايت آن شكل گرفته است كه عموماً در تعهدات و كنوانسيونهاي منطقهاي و فرامنطقهاي حقوق بشر نمايان گرديدهاند. وليكن هنوز اين پرسش باقي است كه ماهيت قوانين و قواعد مربوطه به حقوق بشر چيست؟ و تا چه حدي دولتها خود را ملتزم به مراعات آن ميدانند؟ ما در اين مقال به دو پرسش فوق پاسخ خوهيم داد و به موضوع اَمريّت در حقوق معاهدات 1969 م اين قواعد را چنين تعريف كرده است: «قاعده آمره بينالملل قاعدهاي است كه با اجماع جامعه بينالمللي كشورها به عنوان قاعدهاي تخلف ناپذير كه تنها با يك قاعده بعدي حقوق بينالملل عام با همان معاهدات مرجع تشخيص قواعد جامعه بينالمللي است و منظور جامعه بينالمللي مطلق نيست بلكه جامعه بينالمللي نسبي است كه مشتمل بر دستهبنديهاي مؤثر در روابط بينالمللي است. بنابراين اگر چنين جامعهاي قاعده­اي را كم و بيش بهعنوان قاعده آمره قبول داشته باشد، آمريّت خواهد يافت. متعاقب پيدايش مشكلاتي كه در اين تحليل حقوقي راه يافت، سرانجام كميسيون حقوق بينالملل مطابق ماده 66 كنوانسيون حقوق معاهدات، ديوان دادگستري لاهه را براي تشخيص اين قواعد صالح دانست. كميسيون حقوق بينالملل تا به حال تنها منع كاربرد غير قانوني زور را جزء قواعد آمره شناخته است.<span style='font-family:"Arial","sans-serif";
